Defence of a multi-million pound claim for a commercial tenant on a 60,000 square foot office building. Over £1.2 million reduction on the Landlord's claim achieved through our experience and negotiating the claim.

Brief

Our client was a long standing tenant of this circa 60,000 square foot office building on a business park in Oxford. They were coming to the end of their lease and had plans to move to another location.

The Landlord served them with a terminal dilapidations claim totalling over £3 million. We were asked to provide professional representation for the tenant to manage and negotiate the claim on their behalf.

Delivery

Our initial steps was to review the lease documents including historic leases and licences linked to the tenant’s occupation and also to inspect the property with the Landlord’s dilapidations schedule. Once this initial piece was done we prepared a line by line response to the claim which formed an initial and formal response to the claim.

From here we were the main point of contact on the tenant’s side for negotiations with the Landlord and their surveyors whilst our client could carrying on with their business operation.

Outcome

Our experience in assessing leases and negotiating claims allowed us to find limitations in the Landlord’s claim due to their plans for the property, following lease expiry, along with inflated cost estimates.

Ultimately our expertise and pragmatic advice, led to achieving a saving of over £1.2 million pounds for our client which was agreed before exit.
